These Terms of Service (the “Terms”) govern your access to and use of the Outdey website, mobile applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
1. Who we are
Outdey Entertainment Limited (“Outdey”, “we”, “us”, or “our”) provides tools to discover events, sell and buy tickets, and manage community experiences.
2. Acceptance of Terms
By using the Services, you confirm that you have read, understand, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
3. Eligibility
You must be at least the age of majority in your jurisdiction (or have parental consent) to use the Services. You are responsible for ensuring your use is permitted by applicable laws.
4. Accounts and Security
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for activities under your account. Notify us immediately of any unauthorized use.
- We may suspend or terminate accounts for violations of these Terms or suspected misuse.
5. Event Creation, Tickets, and Fees
- Organizers are responsible for the accuracy of event details, pricing, taxes, and compliance with laws.
- Outdey’s service fees are disclosed at checkout. The fixed portion is per order; percentage is applied to the gross.
- Refunds are subject to the organizer’s policies and applicable law. Outdey may assist but is not the merchant of record unless stated.
- We may withhold, delay, or reverse payouts for fraud prevention, chargebacks, or policy violations.
6. User Conduct
- Do not use the Services for illegal, harmful, or infringing activities.
- No harassment, hate speech, intellectual property infringement, or spamming.
- Respect venue rules, age restrictions, and local regulations for events you attend.
7. Usernames & Impersonation
- Usernames must be unique and may not mislead, impersonate others, or include profanity or slurs.
- We may restrict reserved words (e.g., brand or system terms) and rate‑limit username changes.
- Report suspected impersonation via in‑app reporting tools; we investigate and may take action.
8. Content and Intellectual Property
- You retain rights to content you submit. You grant Outdey a non-exclusive, worldwide license to host, display, and distribute such content to provide the Services.
- Do not upload content you do not have rights to. We may remove content that violates rights or policies.
- Outdey trademarks, logos, and the Services are protected by intellectual property laws.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to those practices.
10. Third‑Party Services
The Services may link to or integrate with third-party services. We are not responsible for their content, policies, or practices.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Outdey shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from your use of the Services, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless Outdey, its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.
14. Termination
We may suspend or terminate access to the Services at any time for any reason, including violations of these Terms. Upon termination, your right to use the Services will cease immediately.
15. Governing Law and Disputes
These Terms are governed by the laws of Trinidad & Tobago, without regard to conflict of laws principles. Disputes will be resolved in the courts of Trinidad & Tobago unless otherwise required by law.
16. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
